WAIVER

I, the undersigned acknowledge the inherit risk involved in basketball and activities conducted on hardwood floors and all sports relating thereto.  Accordingly, in consideration of being allowed to participate in any activities and/or other activities at the Academy or any other assigned venues, I agree to the following:

(1) I acknowledge and fully understand that I will be engaging in activities that involve risk of injury;
(2) I agree that prior to participating in any activity I will inspect the competition area and all equipment to be used.  If I determine that anything related to that activity is unsafe, I will immediately advise my coach or an official of the venue of this unsafe condition and will not participate until this condition is corrected;
(3) I agree to assume all the foregoing risk and accept personal responsibility for my own damages following such injury, permanent disability or death;
(4) I release, waive, discharge and covenant not to sue licensor, Academy, and all respective agents, affiliates, associates, officers, directors, owners and employees (collectively “Releasees”) from demands, losses, or damages on account of any injury, death or damages to property, caused or alleged to be caused in whole or in part by my actions.
(5) I also understand that the exercise equipment located in the Court 3 area is not part of the Tarkanian Basketball Academy. No one is permitted to use the equipment in any manner without permission by Athletes Performance. I hereby instruct my child/ren not to play on or around the exercise equipment. I will be responsible for the repair and/or replacement of any and all equipment damaged resulting from the unauthorized use of said equipment by myself and/or my child/ren.
(6) I acknowledge and fully understand that I am to remain inside the Academy facility at all times during any scheduled event, league, skill session, camp and/or practice in which I am a participant and that I am not to exit the Academy building without direct supervision of my parent and/or guardian. If I do leave the Academy building I do so at my own risk and accept responsibility for my own damages as a result of my actions. TBA, it's employees, agents, owners, coaches, administrators are not responsible for children who leave the facility unaccompanied by their parent and/or guardian and who are not being supervised by their parent and/or guardian.
(7) I agree that all fees associated with my participation at Tarkanian Basketball Academy recreation leagues will be paid in full no later than the fourth week of the league unless other arrangements are made and agreed to in advance. I am aware that if my check is returned for any reason, I will be required to pay the full amount in addition to a $5.00 returned check fee via credit card, debit card, cash, or money order, and no further personal checks will be accepted for payment.
(8) I agree that Tarkanian Basketball Academy is not responsible for personal items left inside the facility and that the parent/child are responsible for the security of their own personal items.
(9) I agree that I will escort my child/children inside the TBA facility and escort them out of the facility when their event has concluded. TBA is not responsible for any child left unattended inside or outside of the facility and that parents and/or guardians are responsible for the supervision of all of their children at all times.

REFUND POLICY

                 TBA will refund the full amount of the fees paid prior to the date of the jamboree scheduled for your child's division in the current league.  The fees for the uniform will be refunded as long as the uniform has not been picked up.  Once the uniform is picked up, we cannot refund that amount or take back the uniform.  After the date of the jamboree, if your child is unable to complete his/her participation in the league, we will credit you the pro-rated amount which can be used for a future league or summer camp.  No refunds will be given after the jamboree.
